Privacy Notice

In compliance with the provisions of articles 3 (section I), 16, 17, 18, 21, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, and 36 of the General Data Protection Law on Personal Data Held by Private Parties (hereinafter, the "GDPLPDPP"), the following Comprehensive Privacy Notice is made available to data subjects:

I. Identity and address of the responsible party collecting the data.

In accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties, this privacy notice is made available under the following terms: Responsible for the use and protection of personal data: HumanSmart Consulting, S.C., located at Av. Monte Carmelo Privada 6, #463-5 Haciendas de San Jose C.P.45509 Tlaquepaque, Jalisco, Mexico; and as the data controller, it is made known that our customers' information is treated strictly confidentially therefore, by providing your personal data, which are:

•  Full name. 
•  Address. 
•  Federal Taxpayer Registry. 
•  Email. 
•  Phones. 

It is highlighted that in terms of article 3, fraction VI of the LGPDPPP, none of the data recorded correspond to sensitive personal data, so they will be safeguarded with strict confidentiality by HumanSmart Consulting, S.C.

II. Purposes of data processing.

HumanSmart Consulting, S.C., through its data processing controller, carries out the processing of the data mentioned in the previous section, in accordance with articles 3 section I, 16, 17, 18, 21, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, and 36 of the LGPDPPP. The aforementioned data will be used for:

Allow access to the online conferences, courses, and workshops offered by HumanSmart Consulting, S.C., on topics related to business and labor that are of interest to our clients and their employees.

•  Issue invoicing documents. 
•  Inform about changes to our products or services.
   
•  Evaluate the quality of the service.
   
•  Conduct internal studies on consumption habits.
   
•  Comply with legal requirements from competent authorities.
   

The data processor shall not carry out the processing of personal data for purposes other than those expressly indicated in this privacy notice, nor shall it transfer personal data to other controllers, whether public or private, except those which are strictly necessary to comply with information requests from a competent authority, that are duly founded and motivated.

III. Options and means that the data controller offers to data subjects to limit the use or disclosure of data.

To prevent unauthorized access to your personal data and to ensure that the information is used for the purposes indicated in this privacy notice, we have established various administrative, physical, and technical security procedures and measures to prevent unauthorized use or disclosure of your data, allowing us to handle them properly.

If you believe that your right to personal data protection has been infringed by any conduct of our employees or our actions or responses, and presume that there has been a violation of the provisions set forth in the Federal Law on Protection of Personal Data Held by Private Parties in the processing of your personal data, you may file the corresponding complaint or report before INAI.

It is reported that the personal data collected will not be subject to transfers that require the consent of the owner. However, if the owner has any doubts regarding the processing of their personal data, as well as the mechanisms to exercise their rights, they can go to Av. IV. Means to exercise the rights of access, rectification, cancellation or opposition to the processing of personal data.

All your personal data is treated in accordance with the applicable and current legislation in the country, therefore, we inform you that you have the power to revoke this consent at any time through the ARCO rights: to access, rectify, cancel, or oppose the treatment we give to your personal data; a right that you can enforce by submitting the form available in this same document and which our staff will provide you with if required.

The requirements that the application for the exercise of ARCO rights must contain.

•  Name of the holder and their address or any other means to receive notifications;
   
•  The documents proving the identity of the holder and, where applicable, the identity and personality of their representative;
   
•  If possible, the responsible area that processes personal data and to which the request is submitted;
   
•  The clear and accurate description of the personal data for which one of the ARCO rights is sought to be exercised;
   
•  The description of the ARCO right that is intended to be exercised, or what the data subject is requesting, and
   
•  Any other element or document that facilitates the location of personal data, if applicable.
   

Your request must be submitted as follows:

2.  Print and fill out neatly in block letters, using black and legible ink.
    
3.  Send it to the email address betsabeth.sanchez@psicosmart.pro.
    
4.  Attach a document certifying the identity of the Owner, if the transaction is being carried out by a third party, please attach a document certifying the individual's identity and legal representation.
    

The deadlines according to this Law, to provide monitoring and attention are as follows: 20 days counted from the date the request was received. The request may not be appropriate according to Chapter IV, Article 34 of the LFPDPPP.

At any time, you may revoke the consent you have given us for the processing of your personal data, so that we stop using them. To do this, it is necessary to submit your request by email.

V. Data transfers that are carried out.

HumanSmart Consulting, S.C. may only transfer your personal data to its affiliated or subsidiary companies that are identified or associated with HumanSmart Consulting, S.C. It will also transfer data solely to its authorized distributors and/or third-party service providers with whom it has a legal relationship, as well as to National or Foreign third parties.

VI. Procedure and means by which the controller will communicate changes to the privacy notice to the data subjects, in accordance with the provisions of this Law.

This privacy notice may be modified at any time by HumanSmart Consulting, S.C., and such modifications will be notified by physical notice at the establishment or through electronic means. We reserve the right to make modifications or updates to this privacy notice at any time, to address new legislative developments, internal policies, or new requirements for the provision or offering of our services or products.

These modifications will be available to the public through the following means:

This Privacy/Confidentiality statement is subject to the terms and conditions of HumanSmart Consulting, S.C., which constitutes a legal agreement between the user and HumanSmart Consulting, S.C.
